Terms of Service

These Terms of Service govern your use of Opus Fuel, the fuel-stop planning service operated by ESL Trucking Inc ("Opus Fuel", "we", "us"). By creating an account or using the service you agree to these terms on behalf of yourself and the company you represent. If you do not agree, do not use the service.

Opus Fuel plans fuel stops for commercial trucks using telematics data you connect, fuel discount files you upload, published truck-stop prices, and truck-safe routing. The plans, prices, savings figures, and routes we show are estimates produced from the data available to us at the time. They are not guarantees of price, availability, discount eligibility, or road conditions.

You are responsible for verifying prices at the pump, for driver safety, for hours of service and other regulatory compliance, and for every operational decision made using the service.

You must provide accurate account and company information and keep your login credentials confidential. One organization represents one company. You are responsible for all activity by users you invite to your organization.

You own your fleet, location, vehicle, fuel, and discount data. You grant Opus Fuel a license to store and process that data only as needed to operate the service for you. We do not sell your data.

Integrations such as Samsara and Telegram are governed by their own terms. You confirm you are authorized to connect them and to share the resulting data with us.

Fees are as agreed with you in writing, whether by card through the service, by invoice, or by bank transfer. Fees are billed in advance for each billing period and are non-refundable except where required by law. We may suspend access for non-payment after notice.

You may not resell or sublicense the service, scrape or bulk-export data other than your own, reverse engineer the service, attempt to access other organizations' data, interfere with the service's operation, or use it for any unlawful purpose.

We work to keep the service available but do not guarantee uninterrupted operation. Third-party providers we depend on (telematics, routing, hosting, messaging, and AI parsing) may experience outages outside our control, and we may perform maintenance that temporarily limits access.

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

To the fullest extent permitted by law, Opus Fuel is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost fuel savings, fuel purchase decisions, routing outcomes, or third-party outages. Our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the claim arose.

You may stop using the service and close your account at any time by emailing us. We may suspend or terminate accounts that breach these terms. After termination we delete your data as described in the Privacy Policy.

We may update these terms. Material changes will be announced in the service or by email at least 14 days before they take effect. Continued use after that date means you accept the updated terms.

These terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Illinois.
